Irreplicability is framed as crisis, blamed on sloppy science motivated by perverse stimuli in research. Structural changes to the organization of science, targeting sloppy science (e.g., open data, pre‐registration), are proposed to prevent irreplicability. While there is an unquestionable link between sloppy science and failures to replicate/reproduce scientific studies, they are currently conflated. This position can be understood as a result of the erosion of the role of theory in science. The history, sociology, and philosophy of science reveal alternative explanations (...) for irreplicability to show it is part of proper, informative and valuable science. Irreplicability need not equate research waste. Sloppy science is the problem, also when results do replicate. Hence, the solution should focus on opposing sloppy research. (shrink)

Broad genome-wide testing is increasingly finding its way to the public through the online direct-to-consumer marketing of so-called personal genome tests. Personal genome tests estimate genetic susceptibilities to multiple diseases and other phenotypic traits simultaneously. Providers commonly make use of Terms of Service agreements rather than informed consent procedures. However, to protect consumers from the potential physical, psychological and social harms associated with personal genome testing and to promote autonomous decision-making with regard to the testing offer, we argue that current (...) practices of information provision are insufficient and that there is a place – and a need – for informed consent in personal genome testing, also when it is offered commercially. The increasing quantity, complexity and diversity of most testing offers, however, pose challenges for information provision and informed consent. Both specific and generic models for informed consent fail to meet its moral aims when applied to personal genome testing. Consumers should be enabled to know the limitations, risks and implications of personal genome testing and should be given control over the genetic information they do or do not wish to obtain. We present the outline of a new model for informed consent which can meet both the norm of providing sufficient information and the norm of providing understandable information. The model can be used for personal genome testing, but will also be applicable to other, future forms of broad genetic testing or screening in commercial and clinical settings. (shrink)

Background: As genetics technology proceeds, practices of genetic testing have become more heterogeneous: many different types of tests are finding their way to the public in different settings and for a variety of purposes. This diversification is relevant to the discourse on ethical, legal and societal issues (ELSI) surrounding genetic testing, which must evolve to encompass these differences. One important development is the rise of personal genome testing on the basis of genetic profiling: the testing of multiple genetic variants simultaneously (...) for the prediction of common multifactorial diseases. Currently, an increasing number of companies are offering personal genome tests directly to consumers and are spurring ELSI-discussions, which stand in need of clarification. This paper presents a systematic approach to the ELSI-evaluation of personal genome testing for multifactorial diseases along the lines of its test characteristics.DiscussionThis paper addresses four test characteristics of personal genome testing: its being a non-targeted type of testing, its high analytical validity, low clinical validity and problematic clinical utility. These characteristics raise their own specific ELSI, for example: non-targeted genetic profiling poses serious problems for information provision and informed consent. Questions about the quantity and quality of the necessary information, as well as about moral responsibilities with regard to the provision of information are therefore becoming central themes within ELSI-discussions of personal genome testing. Further, the current low level of clinical validity of genetic profiles raises questions concerning societal risks and regulatory requirements, whereas simultaneously it causes traditional ELSI-issues of clinical genetics, such as psychological and health risks, discrimination, and stigmatization, to lose part of their relevance. Also, classic notions of clinical utility are challenged by the newer notion of 'personal utility.'SummaryConsideration of test characteristics is essential to any valuable discourse on the ELSI of personal genome testing for multifactorial diseases. Four key characteristics of the test - targeted/non-targeted testing, analytical validity, clinical validity and clinical utility - together determine the applicability and the relevance of ELSI to specific tests. Heidegger and East-Asian thought have traditionally been strongly correlated. However, although still largely unrecognized, significant differences between the political and metaphysical stance of Heidegger and his perceived counterparts in East-Asia most certainly exist. One of the most dramatic discontinuities between East-Asian thought and Heidegger is revealed through an investigation of Kitarō Nishida’s own vigorous criticism of Heidegger. Ironically, more than one study of Heidegger and East-Asian thought has submitted that Nishida is that representative of East-Asian thought whose philosophy most closely (...) resembles Heideggerian thought. In words that then and now resound discordantly within the enshrined, established view of Heidegger’s relationship to East-Asian thought, Nishida stated uninhibitedly his own view of Heidegger in the noteworthy statement: “Heidegger is not worth your time… He…does not recognize that which is indispensible and decisive, namely, God.” This present study lays out for the first time in English, the significant differences between the metaphysical and political stances of Nishida and Heidegger, Nishida’s own critique of Heidegger, and Heidegger’s own rather dismal assessment of non-Western philosophy, all of which demonstrate a remarkable, hitherto unrecognized discontinuity between Heidegger and East-Asian thought. The concept of Nothingness—Japanese mu or Chinese wú 無—is central both to the Kyoto School and to important strands of Chinese philosophy. The Kyoto School, which has been active since the 1930s, is arguably modern Japan’s most philosophically sophisticated challenge to Western thought. Further, as contemporary East Asia continues to rise in importance, East Asians and Westerners alike are beginning to consider anew the contemporary philosophical relevance of Confucianism, Daoism, and East-Asian Buddhism. These originally Chinese traditions were certainly important influences (...) directly and indirectly on Kyoto School philosophy itself. At the very least, Kyoto thought and Chinese thought share foundational structural resemblances, especially regarding the concept of Nothingness. This study summarizes the concept of Nothingness in the Kyoto School and in Chinese philosophy, and then offers an evaluation of the contemporary relevance and general coherence of this concept. Despite government policy and initiatives for remote areas, indigenous people are amongst the most disadvantaged and do exhibit higher levels of unemployment in the Australian community. A number of commentators have suggested that better educational opportunities for this minority group will considerably improve their socio-economic status and employment opportunities. This myth is exposed in this article, which reports evidence from an educational–vocational programme for Yolngu who are the indigenous people of East Arnhem Land in the Northern Territory of Australia. Arnhem Learning Education and Regional Training programme is conducted, mainly at Nhunlunbuy, in partnership with Rio Tinto Alcan and the Charles Darwin University, with the primary objective of preparing indigenous people for mainstream sustainable jobs. The presented content suggests that while higher educational status is important, this sole strategy is unlikely to comprehensively address outstanding issues that are confronting indigenous people and their labour market concerns. Despite the central role that the concept of God played in Kitarō Nishida's philosophy—and more broadly, within the Kyoto School which formed around Nishida—Anglophone studies of the religious philosophy of modern Japan have not seriously considered the nature and role of God in Nishida's thought. Indeed, relevant Anglophone studies even strongly suggest that where the concept of God does appear in Nishida's writings, such a concept is to be dismissed as a 'subjective fiction', a 'penultimate designation', or a peripheral Western (...) intrusion with no genuine relationship to the core of Nishida's thought. However, a careful study of Nishida's own writings reveals that for Nishida, in his own words, God is 'that which is indispensable and decisive'. For the first time in English, this present study reveals Nishida's view of God, especially examining Nishida's debt to the theologian Karl Barth and Christianity. (shrink)

While the preponderance of recent literature on David Gauthier's Morals by Agreement has focused on his theory of bargaining,1 Joseph DeMarco calls into question the foundation of Gauthier's project.2 DeMarco argues that Gauthier's project depends on the incorporation of extra‐rational values, thereby undermining his attempt to derive morality from the non‐moral premises of rational choice. On DeMarco's account, there are at least three points where Gauthier depends on extra‐rational values. DeMarco finds the first two of these points problematic because he (...) misunderstands Gauthier's theory of rational choice. The third point is more serious; Gauthier does not offer an apparatus sufficient to respond to DeMarco's charge. To disarm DeMarco's third objection, I shall offer a justification of the rationality of autonomous preference formation. (shrink)

In this paper, we explore the role of reciprocity in the employment of restrictive measures in contexts of contagion. Reciprocity should be understood as a substantive value that governs the use, level and extent of restrictive measures. We also argue that independent of the role reciprocity plays in the legitimisation the use of restrictive measures, reciprocity can also motivate support and compliance with legitimate restrictive measures. A number of studies have tested the relationship between a corporation's social and ethical performance and its financial performance. In contrast, this is the first study to demonstrate a link between overall financial performance and an emphasis on ethics as an aspect of corporate governance. It identifies the 26.8 percent of the 500 largest U.S. public corporations that, in their annual report to shareholders, commit to ethical behavior toward their stakeholders or emphasize compliance with their code of conduct. The financial (...) performance of these corporations ranks higher than that of those who do not at a significance level of p = < 0.005, using the 1997 Business Week ranking which averages eight publicly-reported measures of historical financial performance. Evidence of an emerging focus on the role of farmer knowledge in developed countries is highlighted by the debate on the nature of local and scientific knowledge. Less attention has been paid to the interaction of different ways of knowing for sustainable capital-intensive agriculture. This paper explores the relationship between local and scientific knowledge in managing temperate pasture and grazing systems in Australia. The nature of farmer knowledge is firstly examined by describing the experiences of farm families in managing native (...) and introduced perennial grasses in upland areas of the Murray-Darling Basin. The building of knowledge and skills through social learning was explored in group case studies and interviews with stakeholders involved in pasture research and development. The interchange of local and scientific knowledge in groups was shown to have a synergistic effect, whereby local knowledge was broadened and strengthened, and scientific knowledge adapted and molded to specific situations. The effectiveness of social learning was greatest in collaborative programs based on small, local groups involved in monitoring and evaluation of whole farm pasture and grazing systems. (shrink)

Several recent commentators have suggested that for fully rational agents who find themselves in iterated prisoner's dilemmas of indefinite length, co-operation is the rational strategy. Their argument is that these fully rational agents can be taught, through the co-operative actions of other agents, to bypass the dominant move of noncooperation and co-operate instead. The proponents of the “teaching strategy” seem to have ignored the compelling argument of Jordan Howard Sobel. While the teaching argument may work for agents who are less (...) than purely rational, Sobel has pointed out that hyperrational utility maximizers cannot be taught; they reason deductively, not inductively, as the “teaching argument” requires. Liberal societies conventionally treat religion as unique under the law, requiring both special protection and special containment. But recently this idea that religion requires a legal exception has come under fire from those who argue that religion is no different from any other conception of the good, and the state should treat all such conceptions according to principles of neutrality and equal liberty. Cécile Laborde agrees with much of this liberal egalitarian critique, but she argues that a simple analogy between (...) the good and religion misrepresents the complex relationships among religion, law, and the state. Religion serves as more than a statement of belief about what is true, or a code of moral and ethical conduct. It also refers to comprehensive ways of life, political theories of justice, modes of voluntary association, and vulnerable collective identities. Disaggregating religion into its various dimensions, as Laborde does, has two clear advantages. First, it shows greater respect for ethical and social pluralism by ensuring that whatever treatment religion receives from the law, it receives because of features that it shares with nonreligious beliefs, conceptions, and identities. Second, it dispenses with the Western, Christian-inflected conception of religion that liberal political theory relies on, especially in dealing with the issue of separation between religion and state. As a result, Liberalism's Religion offers a novel answer to the question: Can Western theories of secularism and religion be applied more universally in non-Western societies?--. (shrink)

This collection of essays endeavors to generate a dialogue between Eric Voegelin and other prominent twentieth-century thinkers and explore some of the more perplexing issues in contemporary political theory. Each essay rests on the underlying question: is it possible or desirable to construct or discover political foundations without resorting to metaphysical or essentialist constructs? The introduction focuses on the two nineteenth-century thinkers, Nietzsche and Husserl, who have framed the debate about modernity and postmodernity; thereafter, the book examines Voegelin's ideas as (...) compared to those of other twentieth-century thinkers. Discussed within the volume are Levinas and the precedence of ethics, Ricoeur's theory of narrative representation, Deleuze and the philosophy of immanence, Voegelin's relationship to a speech- dimension theory of human behavior, and Patocka's theory of pre- metaphysical transcendence in Socrates. What will impress scholars most about this collection is the provocative dialogue created between Voegelin and other major thinkers of postmodernism that addresses the issue of establishing foundations without foundationalism. Although managers must stay abreast of all socictal concerns in developing organizational objectives, protecting the environment seems to be a major issue for consumers in the 1990s. This increased environmental concern leaves managers no choice but to go beyond mere social obligation when it comes to protecting the environment. Society is demanding social responsiveness at a minimum, and the call for social responsibility seems to be getting louder and clearer. This paper reviews the response business has made to this call (...) for responsibility for the environment. Specifically, this paper will address the impact of increased business awareness on: (1) the passage of laws and legislation to protect the environment (social obligation); (2) specific organization actions to meet consumer demands (social responsiveness); (3) specific organization endeavors which reflect a sincere attempt to address the environmental issue (social responsibility). This paper argues that there may be instances where assessing wildlife for monetary valuation might be quite reasonable and useful for public policy, even when there are strong arguments against valuation of wildlife and nature. A case of deer population management is considered where continued growth of the deer population will lead to more property damage and habitat loss. However, deer population control raises ethical questions on the rights of animals to exist and on the rights of humans to arbitrarily (...) interfere. The contingent valuation methodology is used to value preferences for deer management for the purpose of guiding public policy. The valuation estimates show that ethical concerns about killing deer affect the level of willingness to pay in a quite a logical manner. However, for individuals with rights-based preferences, CVM is not appropriate. The survey results also show that individuals with rights-based preferences are a small minority in this particular example. (shrink)

There are over 2,500 Landcare groups with 65,000 members operating across Australia. With considerable evidence of program impact, Landcare is an important example of state sponsored community participation in natural resource management. However, the authors suggest excessive emphasis has been placed upon attitudinal change - the development of landholder stewardship, as the lever for effecting major changes in land management. Analysis of data from a landholder survey failed to establish predicted stewardship differences between Landcare and nonLandcare respondents or between those (...) who joined early/late, or participated more/less in group activities. And there was no relationship between stewardship and adoption for most of the sustainable agriculture practices surveyed. Further analysis clearly linked Landcare participation and concern about the environmental and economic impacts of land degradation. Whilst respondents were significantly more concerned about economic impacts, research findings were consistent with earlier work indicating that most land managers have a strong stewardship ethic. The authors also suggest that concerns that Landcare is not addressing biodiversity conservation are largely unjustified and reflect urealistic expectations of these voluntary groups. (shrink)

While the ethical use of deception has been discussed in literature, the ethics and acceptability of nursing deception has yet to be studied. The current study examined nurses’ and nursing students’ ratings of the ethics and acceptability of nursing deception. We predicted that nurses and nursing students would rate a truthful vignette as more ethical than a deceptive vignette. We also predicted that participants would rate nursing deception as unethical and unacceptable. A mixed design was used to examine ethics scores (...) as a within-subjects factor and order as a between-groups design factor. A total of 131 nurses and nursing students were recruited from university nursing programs and hospitals in Texas. Participants were provided with a truthful vignette and deceptive vignette and used the Multidimensional Ethics Scale-Revised 1 to rate each vignette. Participants also completed the Lies in Nursing Ethics Questionnaire. The truthful nursing vignette was rated as more ethical than the deceptive vignette. Results indicated that most participants rated nursing deception as unethical, unacceptable, and a violation of the ANA ethical code. Some participants deemed that nursing deception may be acceptable within some cases. Age and years of experience were not related to the perceived ethics and acceptability of nursing deception. Nurses and nursing students believe that using deception with patients is unethical and unacceptable. However, some participants believed that deception may be warranted within some cases. These findings may reflect nurses’ placing the patient at the core of their values and viewing honesty as important for the nurse-patient relationship.
